1. Services to Be Performed

Neighbourhood Junk Removal ('Contractor') agrees to provide junk removal, hauling, and disposal services at the address listed above ('Service Location') on the date specified. The scope of work is limited to the items and areas mutually agreed upon prior to commencement of work.

Contractor reserves the right to decline removal of:

• Hazardous materials (paint, chemicals, asbestos, biological waste, propane tanks)
• Items that are inaccessible or require specialized equipment not brought to site
• Items prohibited by municipal or provincial disposal regulations

2. Client Responsibilities

By signing this agreement, the Client confirms and agrees to the following:

• The Client has the legal right and authority to authorize removal of all items listed for disposal.
• The Client has disclosed all relevant information about the property, items, and access conditions prior to the job.
• The Client has removed or secured any items they wish to keep before work begins. Contractor is not responsible for items accidentally removed that were not clearly marked or separated.
• The Client has ensured safe and unobstructed access to all areas where work is to be performed.
• If the property is a rental or suite, the Client confirms they have obtained all necessary authorization from the property owner.

3. Pricing & Payment

The quoted price is based on the scope of work agreed to before the job starts. The final invoice may differ if:

• Additional items are added to the job after the initial quote.
• Access conditions are materially different from what was described.
• Weight or volume exceeds the estimate upon arrival at the disposal facility.

Payment is due upon completion of the job. Invoices unpaid after 7 days may be subject to a late fee of 2% per month. Contractor reserves the right to withhold disposal confirmation until payment is received in full.

4. Pre-Existing Damage & Property Condition

The Client acknowledges that:

• It is the Client's responsibility to point out any pre-existing damage, fragile surfaces, or areas of concern before work begins. Contractor will not be held liable for damage to surfaces, walls, floors, or fixtures that were not disclosed prior to commencement.
• Contractor will take reasonable care during the removal process. However, incidental contact with walls, doorframes, floors, or tight spaces is inherent to junk removal work. Minor scuffs or marks in high-traffic areas are a normal result of this type of service.
• Contractor is not responsible for damage to items that are structurally unsound, overloaded, or fragile by nature (e.g., rotting wood, cracked drywall, old plumbing fittings) that break or fail during normal handling.
• If the Client has specific concerns about any area or surface, they must communicate this before work begins. Contractor will advise if the requested work poses an unacceptable risk and may decline that portion of the job.

5. Limitation of Liability

To the fullest extent permitted by applicable law:

• Contractor's liability for any claim arising from this agreement shall not exceed the total amount paid by the Client for the specific job in question.
• Contractor shall not be liable for any indirect, incidental, consequential, or punitive damages including lost profits, loss of use, or damage to items of sentimental or undisclosed value.
• Contractor is not liable for damage caused by the Client's failure to disclose pre-existing conditions, structural deficiencies, or hazardous materials on the property.
• Contractor carries general liability insurance. A certificate of insurance is available upon request.

6. Damage Claim Process

In the unlikely event of damage believed to be caused by Contractor, the Client agrees to:

• Report the damage to the Contractor in writing (text or email) within 48 hours of job completion.
• Provide photos documenting the damage and its location.
• Allow the Contractor a reasonable opportunity to inspect the damage before any repairs are undertaken.

Claims reported after 48 hours or after repairs have been made without Contractor's inspection may not be considered. Contractor will respond to all valid claims within 5 business days.

7. Cancellations & Rescheduling

• Client may cancel or reschedule with no charge if notice is given at least 24 hours before the scheduled job.
• Cancellations made with less than 24 hours' notice may be subject to a $50 late cancellation fee to cover crew scheduling and travel.
• Contractor reserves the right to reschedule due to weather, equipment issues, or crew availability. Client will be notified as early as possible.

8. Photos & Marketing

Contractor may photograph items, loads, or the job site for internal records, disposal documentation, and marketing purposes. No images that identify the Client or their private property in a recognizable way will be shared publicly without consent. If the Client does not consent to any photography, please indicate below:

9. Governing Law

This agreement is governed by the laws of the Province of British Columbia, Canada. Any disputes arising from this agreement shall be resolved in accordance with BC law.

Client Acknowledgment

By signing below, the Client confirms they have read, understood, and agree to all terms of this Service Agreement & Liability Waiver. The Client acknowledges they had the opportunity to ask questions and had all concerns addressed before signing.
